Trans director Sam Feder's recent documentary "Heightened Scrutiny" offers a compelling two-part viewpoint – simultaneously an intimate profile of a key trans advocate and a critical examination of journalistic reporting about trans rights.

Judicial Struggle at the Highest Court

This documentary traces ACLU lawyer Chase Strangio as he gets ready for oral arguments in the landmark highest court case US v Skirmetti. These arguments took place in late 2024, with the court finally deciding in support of Tennessee's case, effectively enabling limitations on healthcare for transgender young people to remain in place across multiple US territories.

We created Heightened Scrutiny in just 16 months, shared Feder during a conversation. Meanwhile, my earlier film Disclosure took me half a decade, so this was a real push. Our purpose was to generate dialogue so people would learn more about the case.

Human Story Amid Legal Battle

Although Feder presents a comprehensive examination of how mainstream news organizations have disseminated anti-trans narratives, the film's primary contribution may be its engaging portrayal of Strangio. Typically a reserved lawyer in media appearances, Strangio shows his vulnerability throughout the documentary.

This represented a major challenge, to reveal aspects of my life to a camera lens that I had worked hard to keep private, explained Strangio. Feder said he wanted the next generation to know that we fought, to see what was done in defense of these fights for our basic existence.

Diverse Perspectives in the Movement

To support Strangio's account, Feder features various transgender voices, including well-known leaders from activism and entertainment. The documentary also features viewpoints from cisgender advocates who analyze how established media outlets have contributed to negative coverage of trans individuals.

The viewpoint of trans minors central to the court battle is shown through a impressive 12-year-old student named Mila. Audiences first see her fighting for her community at a school board meeting, with subsequent scenes showing her demonstrating for transgender rights outside the highest court.

Intimate Moments Beyond the Legal Battle

Heightened Scrutiny also features emotional moments where Feder moves beyond the ongoing legal battle, such as footage of Strangio traveling in Italy and receiving a body art featuring verses from civil rights leader Pauli Murray's poem "Prophecy."

This body art sequence is one of my preferred parts in the movie, explained Strangio. Receiving body art is almost like a contemplative process for me, to be totally engaged in my body and to view it as a container for things that are significant to me.

Physical Autonomy and Portrayal

The filmmaker's dedication to thoughtfully showing Strangio getting to his body art highlights that this film is primarily about trans bodies – not just those of youth who confront restriction of their ability to live genuinely in their own bodies, but also the physical forms of the numerous subjects who participate in the production.

I make films with a purpose, and part of that is choosing people who are brilliant and eloquent enough to sustain the camera, explained Feder. Whenever people ask me what they should dress for an filming, my reply is anything that makes you feel hot. This is important to me – as trans people, we struggle so much with our image.

Legacy and Optimism

A key aspect that makes Feder's documentaries stand out is his clear skill for making his trans subjects feel comfortable, recognized and admired. This methodology fosters authentic rapport between Feder and Strangio, enabling the director to accomplish his objective of portraying Strangio as a multifaceted person and providing a testament for posterity of how persistently he and others have fought for transgender liberties.

I hope not people to find themselves in a state of constant discouragement because of what the law is denying us, explained Strangio. I aim to be in a method of using the law to minimize harm, but not to transform it into some sort of conduit for our freedom possibilities. The government is not going to be the reflection through which we perceive ourselves. Trans people are that reflection, and it's very vital that we keep having that discussion together with conversations about fighting back these laws and approaches.
